Can I pass MOT if my rims are outside of arches?

Asking because in my country we can't pass MOT with wheels like that

The majority of the tyre tread is under the arch, so it's OK.

I always thought (wrongly as it turns out then) the whole tyre had to be covered

Nope, doesnt matter for mot, but as for legality , construction and use regs say that tyre shouldnt protrude outside arches im led to believe.

Yep, that about right, lot of other occasions where mot and construction/use regs dont match up.

Mot is not a check on construction and use regs, if it was it would cost more than £56.

You'd think that VOSA and DOT would communicate to each other and prevent that occurring, but government departments rarely do

Saw this on one of those motorway cops/patrol programes, it's an offence to have it like that.

But as above, you can pass an MOT with it.

Not entirely sure, you can either get a fine or told to rectify it within a certain amount of days, in the case I saw, the car was being scrapped in less than a week after being spotted so they let them off.
