Android Auto and Google Assistant

So turns out Google Assistant is a selective mute when I connect to the SMAX with Sync 3 and Andriod Auto 

She will beep to acknowledge she is listening and I say a command. If I do this within a few seconds of connecting up she will respond.

 

If I do it mid journey she will beep but no verbal response but will carry out the action providing its a one answer query I.e call someone. So she is listening 

 

Works OK out of the car and within the andriod auto app when not connected to the car. 

 

Ideas welcome. I'm beginning to think it's the Sync 3 cutting her off

I'm shocked no one has this problem. Either Way a Upgrade to the Sync 3 firmware has done the trick
