Is it linked to your brakes or on permanently with the other lights?

Red lights to the rear are fully legal in either case.

I linked mine to the wires to the third brake light so it comes on only when I brake.

Wired up to number plate lights..so permanently on.

Thought it may be ok but just needed to be sure

As long as it's not white (except if linked to the reversing light) or blue you are fine.

Yeah as long as it's red either permanent or braked or white for reverse your fine. I actually really like it an additional brake light :-)
