I got a bed adjustable head rest for my 91 year old dad who I care for to help him in bed,item works fine but stinks of ciggerete smoke.

I detoled it and wiped it then left it thinking it would be ok and then left positive feedback with a comment saying I detoled it as smoke smell but it solved nothing,nurses came round and smelled it and said its hygiene issue how bad it smelled.

Rang ebay they started ''not as described'' over the phone so awaiting return label.

Now just waiting for the response from the seller which seems a right twit, i won't stand for stuff like this but the thing is which I have asked eBay and I can't understand it 100%.

1... If I get a return label do I print it, stick it on the take it to post office at no cost to me and await them to get it then when they I will get my refund.

or

2... If I don't get a response and eBay steps in they will send the label and do the same, send it back wait for refund.

What is the difference as I will still get label then print and send back so there both the same just waiting for 2 weeks for seller first.
