Possible speeding ticket

Drove through a 40mph zone average speed camera doing 43mph was not paying attention also they are new camera's just installed couple of years a go .traffic diversion so not known the area



I dont think youd get done for 3mph over anyway but if you were looking at your cars speedometer I think a lot of them overread the speed you are actually doing by 2-5mph aswell.

It can depend which force area you are in when the offence is committed. Many (but by no means all) work to the 10% + 2mph formula (see list linked below) and if so you will probably be ok taking into account, as Jack mentions, most speedos over-read slightly.

However, I have seen mention that average speed cameras are more accurate and may not have a tolerance, so it could be a case of sweat it out for the next 14 days or so, I'm afraid.

Not necessarily. They send it within 14 days but that could mean you get it a few days after day 14 depending on the post.

I got mine within 5 days though - amazing how cheques take ages and things you don't want to see come quickly!😀

If you were caught by the camera, you will receive a notice of intended prosecution (NIP) letter from the police force in which the offense took place. 
These NIPs have to be sent within 14 days of the occurrence and you will be given a deadline to reply to it by.
It will ask you to name who was the driver at the time. 
If you were clocked by the camera and you have no other points for speeding, you may be offered a speed awareness course in place of points and a fine (you still have to pay to attend the course). 

If you did get caught, and the evidence suggests quite unlikely, you may be offered a 'speed awareness' course. Take it, they're really interesting!

Yep, certainly a better option than fine, points and insurance issues.

Hopefully you'll be fine but still keep an eye open.

Got to ask yourself how accurate is your speedo ? I know in our Fiesta isn't spot on we can be doing 30 but coming up to one of them light up speed advisory signs shows I'm doing 28, gone by the same light up sign in a new Corsa at 30 and it lit up 30, brother in laws BMW lights up the sign at 29 when he's doing 30.......I bet you know the location of such a light up sign ? Pay it a visit and go by it at 30, see what it lights up as taking a note what you are doing.

Speedos are permitted to have an inaccuracy up to 10% 'fast' but they can't underestimate your speed. I haven't really looked at my speedo for years always preferring the speed display on my SatNav which is far more accurate.

As we've already commented, you should be OK but there are no guarantees. If it only happened on the 16th they've got until the beginning of March to issue the NIP. I would count on 3 weeks nail biting for incidents such as this, to be safe.

It shouldn't necessarily involve points/fine. I believe Cumbria do operate Speed Awareness Courses and you should be well within the criteria to be offered one, unless you have already been on one in the last 3 years.
