Just Noticed V5 Is In Previous Owners Name, Now What?

I was in the process of trying to sell my car when I've only just noticed the V5 log book is still in the previous owners name!? :/

I thought it was the garages job to sort this and swap the names over? The problem is I have somehow managed to tax the car whilst it has been registered to the previous owner. I told the garage all of this and they said,

1. The post office should have taken the V5 off me and told me I need to get a new one when I taxed the vehicle.

2. It's still ok to sell the vehicle as V5 is not proof of ownership, if the buyer needs proof you own the vehicle get them to phone us or show them your invoice.

3. When you sell it sign off all the sections the registered keeper is required to sign yourself and send it off to the dvla.

Is this ok?

Also as I've taxed the vehicle while it was still registered in the previous owners name if I send off for a new v5 now I will have to pay tax again when the new one arrives and the previous owner will get my refunded days of tax?

I'm so confused, I just what to sell my car as honestly and as quick as possible. Please help.

You need to contact dvla to discuss the issue and they can sort it, but your possibly going to end in some trouble as you should always make sure the v5 is accurate when you get the car.

It is the new keepers responsibility to ensure the V5 is updated.

Under the new car tax rules the previous keeper will indeed get the refund of remaining tax when the V5 is transferred.

Definitely call DVLA, be aware that this could take a while.
