Overhanging Tree / Council

We have a tree whats about 30ft high branches overhanging over the wall and did want to know

about cutting it back.

But 30ft high.

Now awaiting council to come round the area to see if it needs to be cut back.

We get pigeon muck all over our washing,if you look up it's only overhanging about

4ft but they sit on the end and eat the white berryes.

So just had call off council and when person is around the area they will look at it to see if i can pay

to have it cut back by a firm that they use,so the answer to that will be NO as it don't overhang much.

I always thought that if any branches were hanging over your boundary you were allowed to cut them back to the point they come over.

Might be different being a full tree branch or a old or endangered tree (if that's a thing).

Inform the council of a time you are going to sort it then cut the branches off and throw them back over the fence for the council to collect. I had the same argument with my local authority until i reminded them that i am within my rights to cut off any overhanging branches on my property as long as i return to them what i trimmed off!

Exactly right.

If you were to cut the branches off and burn them then that technically becomes theft.

My argument was more about the amount of leaves in my garden from the trees on the council owned land. The guy tried saying i could be done for fly tipping if i didnt inform them so i just said im informing you now that at some point im going to chop the branches off and leave them on your land. I said the alternative was to send a worker round every week to pick up the leaves to which he said "never going to happen" so i replied "i know and thats why im chopping the branches off, goodbye!"

Ive still not got round to it though so let us know if you get prosecuted and i will leave them alone!:lol:

i would consider going down a nuisance route,breech of there care also point out that pigeon droppings carry certain unpleasant diseases etc.

put the boot on the other foot,if it was your tree THEY would hurrang you to sort it out and then give you an inflated price for doing it.

and before you agree using the contractors make sure you get other quotes from qualified tree surgeons,because you may be paying over the top.

when was the last time it was pol-larded?

I'd also be worried about those squirrels, they look like they're mounting an attack...

Council said ''DO NOT'' cut the tree in any way even the overhang and this was yesterday.

The thing is that i know 100% he won't get a person to cut it with cut backs,do see there point.

But i got a feeling that he won't let me get a person to cut it even if it's the firm they use as the person said.

See they look at the tree and overhang not the mess,well i have to clean it but i have proof on a few pictures.

By the way that pic can be from clean to 24hour whats on the floor.

They cant tell you not to cut it when its on your land. Speak to someone higher up in the office. Only cut off directly above your boundary line though so you dont give them any ammo.

You could also speak to the citizens advice bureau or similar for proper legal advice. I don't think a solicitors letter cost much either.

I don't know,they said not even the overhang and has for cutting off the overhang only,you can get it close but binig 30ft high from the floor it's hit and miss,looking up i should say rough 3ft to 4ft as the berrys are on the end or the branches.

This is a pic and as you can see how high and just a bit of overhang but thats where the

berrys are.

I can see from the pic that the branches are overhanging if they can't see that from standing beside it there blind I'd say cut it screw them its over your property

You may want to double check there isn't a TPO on the tree (Tree Preservation order - http://planningguidance.planningportal.gov.uk/blog/guidance/tree-preservation-orders/) before you do anything. There may be an online link on the local authority site to find this out.

This is what i have to watch,they said on the phone ''DON'T'' cut the tree but it's bad some days.

You can see off the pic's the mess,if they are above say a brantch and do anything it hits the ones below and

goes everywhere,all white dots and i mean cloths the lot.

Search for TPO on the council website and see if they have an online mapping system to check the location and/or send them an email to request confirmation if a TPO may exist on the tree. If there isn't one then go with the above suggestions and cut back to the boundary wall/fence and leave the cuttings on the other side of the fence in a reasonable safe place so as to not block any footway.

If a TPO exists then you will need to seek the advice from the council about any works.
