I was just wondering on how i get hold of T&C's from Ford.

Ive got a big issue with a mechanical problem and they are not doing anything to help me and i want to consult the small print.

Your contract is almost certainly with the selling Dealer and not with Ford. The terms and conditions relating to the sale should be on the order form that you signed to buy the car. There is nothing to stop you contacting Ford to complain if your Dealer is not responding, but your first approach should always be to the dealer. Try a letter to the Dealer Principal if you are not satisfied.

The Sale of Goods Act places responsibility for any problems or faults with any goods with the supplier - In this case the dealer. You should contact them first. If you get nowhere next contact is with the Dealer Principal (head honcho at the dealership site), then head office of the dealer group. If you still get nowhere you can try contacting Ford themselves but ultimately it is the dealer who is legally responsible.

You should have your warranty terms and conditions which will say what is covered by the warranty and what is (on a new car) the responsibility of Ford to repair. If you don't have these then the dealer should be able to provide them. The warranty does not remove responsibility from the dealer but is designed to help expedite and pay for repairs.

You don't say how long you've had the car, how old it is now or the mileage as these have an effect on your rights too.

Is the car on finance? If so, the finance company can also be asked to get involved as the goods (the car) technically still belong to them so they have a legal interest and responsibility too.

The car is 2 years old and done 14k.

You're well within warranty so what is the exact issue? Is the dealer refusing to help/claiming they cannot find the fault or are Ford refusing to pay for the repair under the warranty?

Have you considered taking the car to another Ford dealer and getting a second opinion on the fault and warranty applicability? Different dealers have different levels of ability when it comes to negotiating warranty repairs with Ford.

It took me 6 weeks and several emails to my local dealer to get a warranty explanation. Here is what they came back with

Warranty Explanation

A new Ford car carries a 3 year or 60,000 mile warranty, the first year is a full Ford manufacturer warranty, years 2 & 3 are best described a dealer warranty. The difference between the two warranties is that in the 1st year the cover can be described as ‘bumper to bumper’ with all components being covered for ‘manufacturing defects’ but this does not cover ‘wear & tear / service items / adjustments.

The 2nd & 3rd year has a slightly less comprehensive coverage with more items being classed as service items i.e. the main battery, key fob batteries, some trim items, some water leaks, wipers etc.

To try to explain this better I am attaching a copy of the warranty given to used Ford buyers, this explains what is covered and this is very similar to the 2nd & 3rd year cover on a new car.

I am sure you will appreciate it is difficult to explain every nuance of the various warranties, but I hope this helps.

Thank you for all the replies.

Basically the car over revs in between gear changes 1st to 3rd(to maximum sometimes) and on the last few occasions the dealer never found a fault nor did it over rev when they test drove it. When it went to the dealer all they did was update the ECU and said if it happens again bring it back.

My question is: how many times does it have to come back before anything serious happens? I.E. accident or hit someone due to this fault?

Just before xmas it went into the dealer and it faulted for them.

It goes in next week for a week because they do not know what is causing the malfunction (admitted by the service manager). They also stipulated that if they don't know they have to get a specialist guy to come and look at it.

I am basically writing a complaint to the Ford Dealer where i bought it from and i wanted the terms and conditions of a customer when buying/bought a new car because i am deeply unsatisfied with the don't care attitude and bad customer service.

I have not had chance to enjoy the car because it keeps going in for one thing or another.

Intermittent faults are very difficult to diagnose. The dealer has experienced the fault now and is going to have your car in for a week to try and rectify.

What more do you want them to do?
