Who Has The Right Of Way?

Featured Replies

This is a junction I encounter every morning on my way to work, and soon it will be a road that I'll drive rather than my mother, so I'd like to finally clear up a question I've had for a while... Who has the right of way?

My mother lets the other drivers go unless they expressly flash/wave her on, but technically speaking who has the right to drive and who should wait?

Both ways have a give way sign so I'm clueless...

Only traffic which is currently going along the main road has the right of way, it's up to you to make the judgement of should I go or wait for the other driver to pass, so I believe anyway.

The giveway signs are for the green arrows is what I believe to be correct, so in short neither side has the right of way :) You must simply give way to the green arrow people xD

As I thought! To be honest it wouldn't matter, once the L-plates are on I fully expect drivers to take full advantage.

Yes, you are to yield for traffic passing through the cross-roads, I know that, but it is who can go through said road first that was slightly confusing me.

From where ?

Approaching as you did, you give way to vehicles coming from your left or right on the main carriageway - if they are emerging from opposite you it depends which way you & they are turning

No Mark, I know that you give way to vehicles already on the carriageway, I meant who can merge onto said carriageway first? Us (in this video) or the car in front?

So basically it is just a case of making a decision yourself on who can go first? My mother has been driving for over 25 years so has no problems with it, but I know that when I am behind the wheel I will be slightly apprehensive!

Their is one of these near me and sometimes it's like drag racing to get across due to people going 20MPH+ over the limit :(

Sorry that's partially incorrect

If you are proceeding straight across & the vehicle opposite is making a right turn as in the video YOU have right of way over the vehicle opposite

Sorry that's incorrect

Okay, please could you explain in aid of helping a fellow road user out? :)

Ahh I saw your post thanks :D

So in that situation my mother could have pulled out before the VW and been in the right?

AS said you always give way to traffic from your right, so as the main road has priority they have right of way, the other two people in your video have to give way to those vehicles to their right, as for who goes first there is no rule as such that I know of.

The safest solution would be to turn left and turn around somewhere safe and then come back on yourself but very few of us actually do that. A lot of difficult turns like that these days will often have no right turn sign as it can be just too dangerous most of the time to turn right.

In that scenario you don't want to have an accident as it would end up being a 50/50 blame on the insurance as it would be almost impossible to prove who was at fault, even with a dash cam it would be hard in my opinion.

Yeah, I think if I were driving I would just let the vehicles in front pull out and then go when there was no remaining traffic! That would be the safest way wouldn't it?

Sounds familiar now you have posted that, but either way it's a junction that just wants to cause accidents lol

Damn junctions

Do that on your driving test & you're likely to fail Jamie

Yes

Thanks Mark. It may seem like a stupid question but being 20 years of age and never haven driven makes me feel bad enough, let alone finally getting behind the wheel and then not knowing what to do in circumstances such as the aforementioned.

I just hope I can pick it up quickly as I've lost enough time as it is. I need to get my driving licence and move on with my life ASAP.

Also if you are turning left you have priority over the vehicle opposite you if it's turning right

So if I encountered that on my test (as I may well as I'm sure this is a driving test "route") I should proceed? I only ask as 99% of drivers in this situation (as in the video) pull out thinking they have the right of way, and I would be afraid to go in case they did also and it caused an accident, especially on my driving test.

If you are both proceeding straight across no-one has priority

If you are turning right & the vehicle opposite is turning left THEY have priority

Nope as said by Mondeo that would be classed as hesitation and bad hesitation and not pulling out when you can will result in a fail.

Driving is a skill and an art, people think it is so easy to drive and very rarely remember the highway rules and very rarely drive in the correct manor, it takes years to learn to drive properly and safely whether at low speed or high speeds.

Someone can drive very slowly under the limits in every limit yet still be a very dangerous driver, someone who does not religiously stick to speed limits may also be a safer driver than the previous driver described in my scenario.

Driving is about using your judgement all of the time to be as safe as you can.

In the video the other driver opposite has arrived first & is already making the turn - if you both arrive at the same time & it's safe right & left YOU have priority over the driver turning right opposite you & you should proceed with caution - expecting them to move as well

Also if you are turning left you have priority over the vehicle opposite you if it's turning right

And by not doing so I would be showing "undue hesitation" wouldn't I?

if i come across this i always let the other car out first so theirs nothing to hit when its gone :)
