If it's a large company, they will have an employee handbook. Get a copy and familiarise yourself with their disciplinary procedures. Make sure the procedure is followed to the letter, if not, it's automatically deemed to be 'unfair'.

I would pre-empt any possible pitfalls and speak to ACAS

Lol, I wouldn't put too much weight on the university educated bit.

Difficult (and possibly wrong) to comment without knowing the facts of the case but I'm wondering where is your direct line manager in all this?

It sounds like the sort of thing that they should have dealt with in the first instance by getting to the bottom of it and having a quiet word.

Don't know if you have a union in your company, but in any case if, as Stephen mentions, the company has formalised procedures you should be entitled to have some support from a rep or colleague in any meeting/interview.

Update, I've asked this morning IF a full written complaint has been lodged but everyone keep quiet at the minute.

My only issue is its rather a David v Goliath .... other party is an university educated ex teacher v moi who knows next to nowt about process within a large company.

From what I've tried to find out is if she does put it in writing then I can prove her wrong, does that account for Gross misconduct and a sackable offence 🤔

There will be a company grievance procedure. Usually statements are taken and suspension immediately follows on full pay. An investigation takes place to establish the facts - evidence. Then you are invited back during your suspension for a face to face with or without a union rep. Your employer will then ask you to either return to work by letter after your suspension period with a briefing and a discussion on a way forward or possibly just send a letter terminating your employment if the decision goes against you.You will be able to appeal.

It was first brought to my attention by my line manager that a complaint had been made to him and the person in question wanted a full apology from myself in which I point blank refused and afterwards he tried to mediate between the two of us but the other person was having non of it and wanted to make a point of involving a representative of our HR department which I agreed to.

To cut a long story short  that afternoon I had two further visits from the same person from HR who wanted to try and resolve the matter by having the full facts of what was said, when and by whom. He and my line manager both agreed that I hadn't said what the other person thought I had after speaking to the person I was talking to at the time in question and put that forward to the other person who then more or less called me a liar in front of both my manager and the one from HR and then went on to try and say I was bullying and continued on a bit of a mild rant at which point I walked away.

They continued to talk for a good ten mins afterwards and it was left that the person in question is going to escalate it to HR but as of the end of the shift today nothing has come of it as if yet.

Thank you to all your replies and suggestions so far 👍

Will see what tomorrow brings.

WINO, looks like you safe, belt and braces by all concerned barr the idiot making a mountain out of nothing. Hopefully and i say this reservedly the idiot get a formal reprimand on their record and at worst dismissal.

Thanks, that's what's niggling me atm tbh. Nothing has been said or mentioned regarding what the person accused me of saying and the fact that they more or less called me a liar in front of two managers.

I've also spoken the lady that was working along side the person who accused me and she also confirms that at no point did I enter her work station or intervene in her actions.

The probably only issue here atm is where do I go from here

@Wino, a similar thing happened at a place I worked at and this one had a good ending.

To cut a long story short it was a large building with lots of Kitchenettes and most sections had a Tea fund but one person used to not contribute but would steal everyone else's milk, it was not in my part of the building but everyone in the building knew what was going on including the management.

One day someone in his section put a sticker on their milk to say who it belonged to and for this named person to leave it alone. The person complained to management that he was being bullied and the person who wrote the note had to apologise.

The management knew that it was taking political correctness to extremes and kept a close eye on the milk thieve.

A few months later they had gathered enough evidence that the milk thieve had been conducting his own private consultancy business in work time and using the works computers to do so. They confronted him and allowed him to instantly resign rather than sack him.

Not quite the same as your case but from what you have said I think your management know that this person is a nutcase and one way or another they will not be working there this time next year.

Sit tight, give those in power 7 days to sort it, then escalate to union or ACAS. Your a55 is fully covered. Tell them if not resolved in 7 days you will escalate tp ACAS, they then know you mean business.

In my 'previous life' I drove a truck for a distribution firm , I would quite often be greeted mostly by women car drivers who thought nothing of abandoning their cars blocking my way and they'd say "Oh I'll only be a minute", but if I had to park somewhere where I was blocking someone in I'd get "Are you going to be long there" .
I even had one park with the bumper of her car overhanging the tail-lift !

Non use of indicators .

Drivers who when I'm out for a walk or cycle refuse to move out to give the necessary clearance between me and them .

All use of mobile phones while driving .

Incorrect use of You , Your , Their , There , Were , To , Too , Brought and it's RECEIVE , not RECIEVE .

I don't like getting old........ well, not me personally as I'm still a spring chicken obviously! 😀

I went to see my mum today as usual on a Sunday afternoon. She's at our local care home, lockdown wasn't good for her and dementia has set in etc but I've kinda gotten used to her and her condition.

When I was there today a fella, who I know from speaking to on one of our recycling sites, just walked into mum's room and started speaking the biggest load of absolute sh*te! Poor chap is absolutely away with the fairies!

It just seems like yesterday, although it was obviously before COVID etc that I was speaking to him about trucks etc on the site.

Moral? Enjoy today because you don't know what's around the corner.

Cheers, Happy New Year! I'm away to have another beer....... while I'm still able 🍻

I so get your post. My mum is 85 and recovering from a stroke. I bought her to my house and made a lovely Christmas dinner for us both. I remember she use to make the most amazing dinners, those days will never return, but I will always have those memories. When younger, I use to laugh at folk who told me, well, at least you have your heath. Like anything in life, you don't miss it till you no longer have it... Hope you and your mum have a good new year...

You know your old when whenever you watch a film you recognise from a few years back you Google if the main cast are still alive.

Also don't like the older you get the longer it takes to get over a cold  virus and associated cough sore throat conjunctivitis  and generally feeling like *****. Spent boxing day onwards propped up on sofa so I could get a couple of hours sleep a night.

Happy new year.🤣🤣🤣🤣🤣

Yep, mum's had a couple, at least, mini strokes and heart attacks the last couple of years as well. Not easy seeing them in their autumn years.

Hope you had an enjoyable Christmas dinner with your mum.

Spoke to my Lead manager on NYE and also this morning. The person who threw those allegations at me now accepts that I didnt say what they thought I had.

No apology though for the ***** they put me through. So off to HR after break to register a complaint of unsubstantiated accusations, being called a liar on two occasions and a bully during the process.

In a perfect world a handshake would be an appropriate, way for both of you to put it behind you.

Sadly, soaps like EastEnders for the last 30 years have changed our culture so that everybody is so angry all the darn time, it's a disgusting show and damaging to mental health - just a fav rant of mine!

A polite handshake does NOT sort it, when so much division has been created.

I have to question that ethos. When the late Queen shook Martin McGuinness hand, despite horrendous divisions, it did start the course of much healing...

(Martin McGuinness was the late Deputy Prime Minister of Northern Ireland, and the reported previous leader of the IRA)

I know who he was, it would seem "i may be wrong" that she was under pressure to offer an olive branch as head of state to start a healing process. It's up to the individual how to react and social pressure and political expediency does NOT or should not be a factor.
